Advantage Tyre Solutions  Terms, Conditions & Policies

This page contains the terms, conditions and policies that apply when purchasing products or services from Advantage Tyres, participating in our promotions, or joining the Road Club.

Information about how we collect and use personal information is available in our Privacy Policy.

Advantage Conditions of Sale

These Conditions of Sale apply to all goods and services purchased from Advantage. They take priority over any terms contained in an order, offer or other document provided by the Buyer, unless the Seller agrees otherwise in writing.

1. Definitions

In these Conditions of Sale:

  • Seller, we, us and our mean Beau Ideal Limited trading as Advantage.
  • Buyer and you mean the legal entity purchasing goods or services from the Seller.
  • Website means the Advantage website through which an order is placed.
  • Advantage Store means the Advantage location selected by the Buyer for fitment or service.
  • Booking Date means the date and time selected for the fitting of goods or the provision of services.
  • Order Confirmation means the email confirming that the Seller has accepted an order.

2. Orders and contract formation

The Website, information displayed on it and information contained in our emails are invitations to treat and do not constitute an offer to supply goods or services.

When you submit an order, you make an offer to purchase the selected goods or services in accordance with these Conditions of Sale. A contract is formed only when we accept your order and place it with the relevant Advantage Store for fitment.

We may accept or reject an order, in whole or in part, for any reason. If we reject all or part of an order, we will refund any amount paid for the rejected portion and will have no further liability in relation to that portion.

Only a person or entity capable of entering into a legally binding contract may place an order.

3. Information required when ordering

To place an order, you must complete the Website checkout process and provide all information requested, including your name, contact details and payment information. We may be unable to process an order if required information is incomplete or inaccurate.

When ordering products for a vehicle, you must:

  1. provide the vehicle registration, make and model;
  2. select the correct product and size;
  3. select the quantity required; and
  4. provide any other information requested on the Website.

4. Product selection and tyre sizing

If you use the Website’s “shop by registration” function, the tyre options shown are based on the vehicle’s expected factory tyre size. If the vehicle no longer has its factory tyre configuration, use the tyre-size search instead.

You are responsible for checking that the products, tyre size, load rating and other specifications selected are suitable for your vehicle. You are also responsible for the accuracy and completeness of all information supplied with your order.

We are not responsible where goods or services are unsuitable because you supplied incorrect or incomplete information or selected an incorrect product. This does not limit any rights you may have under applicable law.

We recommend purchasing:

  • at least two matching tyres so both tyres on an axle are compatible; and
  • four tyres for full-time four-wheel-drive or all-wheel-drive vehicles, where required to avoid damage to the vehicle’s drivetrain.

5. Additional work and charges

Additional charges may apply at the time of installation where extra work, parts or labour are reasonably required. This may include:

  1. work required for a customised vehicle;
  2. pre-existing vehicle conditions, including severe misalignment or damaged wheel studs, bolts or related components;
  3. additional suspension components or adjustments required for a lowered vehicle; or
  4. additional work requested by the customer.

Where reasonably practicable, the Advantage Store will discuss additional work and charges with you before proceeding.

6. Authority to carry out work

By purchasing goods or services online, you authorise Advantage and its agents to:

  • carry out the services selected in your order;
  • contact you if additional work or services are required; and
  • drive your vehicle only to the extent reasonably necessary to complete the requested work.

7. Booking and order confirmation

When placing an order, you must select an Advantage Store and an available Booking Date. We do not deliver goods purchased for fitment. The earliest Booking Date available through the Website is generally three days after the order is placed.

The Advantage team will check product and appointment availability and may contact you before the Booking Date. We may also verify information before accepting an order.

Acceptance will be communicated by an Order Confirmation sent to the email address supplied with your order. Subject to these Conditions of Sale, we will use reasonable efforts to complete the order at the selected Advantage Store on the Booking Date.

8. Title and risk

Title to goods purchased through the Website does not pass to the Buyer until the goods have been properly fitted to the Buyer’s vehicle. Risk of loss or damage passes to the Buyer when installation is complete.

9. Prices

Unless stated otherwise, all prices are in New Zealand dollars and include GST. Prices displayed online apply to online orders and may differ from prices offered in-store.

10. Product availability

All orders are subject to product, store and staff availability. We do not guarantee that any product advertised on the Website will be available.

We may change the product range or product specifications at any time without notice.

11. Incorrect prices or information

If a product is listed with an incorrect price, description or other information, we may cancel the affected order even if payment has already been made. If we cancel an order after payment, we will refund the amount paid for the cancelled goods or services.

12. Cancellations, exchanges and returns before fitment

If you no longer require tyres purchased online and they have not been fitted, contact [email protected] to request a cancellation and refund.

If you inspect the tyres before fitment and are not satisfied with them, you may request an exchange or refund. You may be asked to complete a Customer Refund Authority form in-store. Approved refunds will be processed to the original payment method or nominated bank account, as applicable.

Tyres generally cannot be returned for a change of mind after they have been fitted. This does not limit any rights or remedies available under New Zealand consumer law where goods or services are faulty or do not meet applicable guarantees.

For a complaint about a product or service, email [email protected] or use our contact form.

13. Online payment

Online payment processing is provided by DPS. We accept the debit cards, Visa and Mastercard payment options displayed at checkout. When payment details are submitted and authorised, the selected payment method will be charged in New Zealand dollars for the order total.

14. Supply and delays

After accepting an order, we will notify you when the products are available for fitment. Any stated availability or completion time is an estimate provided in good faith. To the maximum extent permitted by law, we are not liable for loss, cost or damage caused by a delay.

We may cancel an accepted order if:

  • a product was listed at an incorrect price or with incorrect information;
  • the product is unavailable;
  • the selected Booking Date is unavailable;
  • a typographical or administrative error has occurred; or
  • a system, technical or similar error has occurred.

If an Advantage Store does not have sufficient products, resources or staff to fulfil an order on the Booking Date, we may ask you to agree to:

  1. a different Booking Date;
  2. fitment at another Advantage Store; or
  3. both a different Booking Date and another Advantage Store.

If we cannot agree on a suitable change, the order will be cancelled. Where payment has already been taken, we will arrange a refund to the original payment method as soon as reasonably practicable.

15. Consumer Guarantees Act 1993

Where the Consumer Guarantees Act 1993 applies, these Conditions of Sale must be read subject to the Buyer’s rights and the Seller’s obligations under that Act. Nothing in these Conditions is intended to exclude, restrict or modify a right or remedy that cannot lawfully be excluded, restricted or modified.

Where the Buyer acquires goods or services for business purposes, the parties agree that the guarantees and remedies in the Consumer Guarantees Act 1993 will not apply to the extent that contracting out is permitted by law.

16. Liability and maintenance guarantee

To the maximum extent permitted by law, the Seller excludes all warranties, representations and guarantees, whether express, implied or statutory, relating to a product or information supplied to the Buyer, including warranties relating to availability, accuracy, completeness, timeliness, non-infringement, merchantability or fitness for a particular purpose.

To the maximum extent permitted by law, the Seller’s total liability to the Buyer for loss, damage or injury arising from a defect in, or non-compliance of, a product is limited to the price paid for that product.

To the maximum extent permitted by law, the Seller is not liable for any loss of profit or any indirect, incidental, consequential or economic loss or damage arising from the Buyer’s access to, use of, or reliance on a product or information supplied by the Seller.

Where a guarantee period is stated, the Seller’s liability for defects arising under normal and proper use and maintenance is limited to repairing or replacing defects caused solely by faulty design, materials or workmanship during that guarantee period. Where no guarantee period is stated, the applicable period is six months from the date of supply, subject always to applicable law.

Defective goods or components must be returned promptly to the Seller unless another arrangement is agreed.

The maintenance guarantee does not cover damage caused by misuse, accident, negligence, improper operation, inadequate maintenance, incorrect installation, modification or adjustment.

The Seller’s liability under the contract and this maintenance guarantee is limited to the Buyer named in the contract. The Buyer’s contractual rights may not be assigned without the Seller’s prior written consent.

17. Errors and omissions

The Seller may correct clerical, computational or other errors or omissions in advertising, quotations, invoices or acknowledgements. Because an error may not be identified immediately, it may be discovered up to 30 days after goods have been supplied.

If the Seller identifies an error or omission, it will notify the Buyer promptly and, where appropriate, give the Buyer the option to return the affected goods for a full refund.

18. Product descriptions

Products, prices, specifications and related information may be modified or improved from time to time.

Although we take reasonable care to keep Website information accurate and current, we do not warrant that all product or pricing information will always be complete, accurate or up to date.

We rely on information provided by suppliers and manufacturers. Product descriptions, illustrations and supporting literature are therefore not binding on the Seller.

If goods do not match their Website description, contact us promptly so we can assess the issue and take appropriate action.

19. Events outside our control

The Seller is not liable for loss or damage arising directly or indirectly from a delay in fitment or a failure to perform an obligation where the delay or failure is caused by circumstances outside the Seller’s reasonable control.

20. Changes to these Conditions of Sale

We may amend these Conditions of Sale by publishing an updated version on the Website. An order will be governed by the version published when that order is submitted.

21. Severability

If any provision of these Conditions of Sale is found to be invalid or unenforceable, the remaining provisions will continue in full force to the maximum extent possible.

22. Disputes and governing law

Any claim or dispute arising under these Conditions of Sale is subject to arbitration in accordance with the Arbitration Act 1996.

These Conditions of Sale and any contract to which they apply are governed by New Zealand law. The New Zealand courts have non-exclusive jurisdiction to hear and determine disputes relating to these Conditions or a related contract.

23. Special offers and additional terms

By accepting these Conditions of Sale, you also agree to any additional terms that apply to a special offer, promotion, finance arrangement or customer-group discount used with your purchase.

Some offers are available only at selected stores. The terms for each offer will identify any additional eligibility or participating-store requirements.

Competition Terms of Entry

These general terms apply to competitions, prize draws, social-media promotions and free-gift offers run by Advantage Tyre Solutions New Zealand. Each Promotion may also include specific terms in the relevant advertisement, entry form or promotional post. If the specific terms conflict with these general terms, the specific terms will apply to that Promotion.

1. Promoter

The competition or promotion (the Promotion) is run by Advantage Tyre Solutions New Zealand (the Promoter, we, us or our).

By entering a Promotion, each entrant confirms that they have read and accepted these terms and any specific terms published for that Promotion.

2. Eligibility

  • Unless the specific Promotion states otherwise, entry is open to New Zealand residents aged 18 years or older.
  • Employees of the Promoter, its agencies, sponsors and promotional partners, and their immediate families, are not eligible to enter.
  • Fleet, commercial and trade customers are not eligible unless the specific Promotion states otherwise.
  • Employees and immediate family members of a promotional collaborator, sponsor or advertising agency are not eligible to enter.
  • Entry is limited to one entry per person unless the specific Promotion expressly allows additional entries.
  • A Promotion may specify a period during which a previous winner is not eligible to win again.

3. Promotion period

The specific terms for each Promotion will state the opening and closing dates and times. Entries received before the opening time or after the closing time will not be eligible.

4. How to enter

The entry method will be stated in the specific Promotion and may require an entrant to comment, like, share, tag another account, submit an online form, make an eligible purchase, or provide evidence of purchase.

Entrants must follow the stated entry instructions and use the required platform or form. Automated, scripted, bulk or duplicate entries, including entries submitted through multiple accounts to gain an unfair advantage, may be disqualified.

5. Winner selection and notification

Unless stated otherwise, winners will be selected at random using a computer-generated draw or under the supervision of an independent observer.

The specific Promotion will state when and how winners will be contacted. A winner may be required to respond within a stated period to claim the prize.

If a selected winner cannot be contacted, does not respond within the required period, is found to be ineligible or does not otherwise comply with these terms, the Promoter may select an alternative winner.

6. Free gift with purchase offers

  • A free-gift offer applies only to the eligible products or services stated in the Promotion.
  • Unless stated otherwise, the gift will be dispatched by courier within 14 working days after the qualifying service or tyre fitment has been completed, or after an eligible product has been collected in-store.
  • Offers may apply to purchases paid by cash, EFTPOS, credit card or approved finance. Standard lending criteria, terms, fees and charges apply to finance transactions.
  • Free-gift offers exclude fleet, commercial and trade customers unless expressly stated otherwise.

7. Prizes and substitutions

  • The prize will be described in the relevant Promotion.
  • Unless stated otherwise, a prize is not transferable, cannot be exchanged and cannot be redeemed for cash.
  • If a prize becomes unavailable, the Promoter may substitute a prize of equal or greater value.
  • A winner may be asked to take part in reasonable publicity relating to the Promotion.

8. Publicity and privacy

By entering, entrants consent to the Promoter using their name, entry and image for reasonable publicity relating to the Promotion, without additional compensation, to the extent permitted by law.

Personal information collected in connection with a Promotion will be used to administer the Promotion, contact winners, fulfil prizes and undertake permitted publicity. Information will be handled in accordance with our Privacy Policy and applicable New Zealand privacy law.

We will not sell entrant information and will not keep it for longer than reasonably necessary for the purposes for which it was collected, subject to any legal or record-keeping requirements.

9. Liability

To the maximum extent permitted by law, the Promoter is not responsible for lost, delayed, incomplete, corrupted or misdirected entries, technical failures, platform outages, or unsuccessful contact attempts. Proof that an entry or notification was sent is not proof that it was received.

Except for liability that cannot lawfully be excluded, entrants release the Promoter from claims arising from participation in the Promotion or acceptance and use of a prize.

10. Disqualification

The Promoter may disqualify an entrant or entry that:

  • is incomplete, altered, illegible or submitted incorrectly;
  • breaches these general terms or the specific Promotion terms;
  • is automated, duplicated, misleading or fraudulent; or
  • attempts to obtain an unfair advantage or interfere with the proper operation of the Promotion.

11. Changes, suspension or cancellation

The Promoter may modify, extend, suspend or cancel a Promotion where reasonably necessary because of fraud, error, technical failure, an event outside the Promoter’s reasonable control or another unforeseen circumstance.

Where practicable, the Promoter will take reasonable steps to minimise adverse effects on eligible entrants.

12. Decisions

All decisions made by the Promoter in relation to a Promotion are final. No correspondence will be entered into, except where required by law.

Refund and Returns Policy

Advantage is committed to providing quality products and services. This policy explains the options available if you change your mind before fitment or believe a product or service does not meet the required standard.

1. Change of mind before fitment

If you no longer require tyres after completing your purchase and they have not yet been fitted, you may request cancellation and a refund.

Contact our team before the fitting appointment. If the request is approved, the refund will be processed to the original payment method.

2. Inspection before fitment

If you inspect the tyres before fitment and are not satisfied with them, you may request an exchange or refund.

The request will be handled in-store and you may be asked to complete a Customer Refund Authority form. Once approved, the refund will be processed to the original payment method or a nominated bank account, as applicable.

3. After fitment

Tyres cannot generally be returned or refunded for a change of mind after they have been fitted to your vehicle.

This does not limit your rights under New Zealand consumer law where a product or service is faulty, is not as described, or does not meet an applicable consumer guarantee.

4. Faulty products or services

If you believe there is a problem with a product or service supplied by Advantage, contact us as soon as reasonably practicable. We will assess the issue and work with you to provide an appropriate remedy in accordance with applicable New Zealand consumer law.

5. How to contact us

For refund and return enquiries, email [email protected] or complete the contact form below.
